İstanbul Sözleşmesi Üzerine Bazı Notlar – Prof. Dr. İlyas ÜZÜM
Özet
“Kadınlara Yönelik Şiddet ve Aile İçi Şiddetin Önlenmesi ve Bunlarla
Mücadeleye İlişkin Avrupa Konseyi Sözleşmesi” başlığı, peşin olarak bize
üç şey söylemektedir. a) Kadınlara yönelik şiddet var, b) Aile içi şiddet var,
c) Bunların önlenmesi için mücadele etmek gerekiyor. Bu bağlamda Sözleşmeye
içerdiği insanî çağrı nedeniyle olumlu yaklaşmak şarttır. Bununla
birlikte Sözleşmenin içeriği, bütün maddelerinin insanî ve kültürel değerlerimiz
açısından uygun olup olmadığı incelenmesi gereken bir husustur. Genel
bir incelemeyle sözleşmenin hükümlerinde bizim toplumsal dokumuza
uygun olmayan maddelerin olduğu açıktır. Bu yazıda tartışmalı maddelerin
içeriğine değinilmekte ve toplumsal dokumuza uygun olabilmesi açısından
genel bir öneri getirilmektedir.

Brief Notes On The Istanbul Convention
Abstract
The heading of “The Council of Europe Convention on Preventing and
Combating Violence against Women and Domestic Violence” tells us three
things in advance: a) There is violence against women, b) There is domestic
violence, c) It is necessary to struggle to prevent these. In this context, it is
necessary to approach positively to the Convention due to the humanitarian
call it contains. However, whether all the articles in the content of the Convention
are suitable for our human and cultural values is an issue that needs
to be examined. With a general examination, it is clear that there are articles
in the convention that are not suitable for our social fabric. In this article, the
content of the controversial items is mentioned and a general recommendation
is made in order to be suitable for our social fabric.
