Hukuk Devleti Anlayışının Türk Tarihi Açısından Değerlendirilmesi – Prof. Dr. Ramazan YILDIRIM
Özet
Hukuk devleti kavramı denince anlaşılması gereken öncelikle devletin
bizzat kendisinin hukuka bağlı olması anlaşılır. Bir başka deyişle devlet sadece
hukuk kurallarını koyan bir varlık değil, koyduğu hukuk kurallarına
öncelikle uyan bir tüzel kişiliktir. Türk tarihi açısından değerlendirildiğinde
hukuk devleti anlayışının farklı uygulamalarla karşımıza çıktığı görülmektedir.
Batı’da hukuk devleti hedefine ulaşmak için mülk devlet anlayışı,
ikincisi polis devlet anlayışı, üçüncüsü devletin işlem ve eylemlerinden hazinenin
sorumlu olacağı anlayışı ve en son da hukuk devleti anlayışı aşamalarından
geçmiştir. Batı’da hukuk devleti hedefine ulaşmada geçirmiş olduğu
aşamalar bizim tarihimizde de farklı şekillerde görülmüştür. Bu çalışmada
hukuk devleti anlayışı Türk tarihi açısından kısaca değerlendirilmekte ve
hukuk devletinin şartları üzerinde durulmaktadır.

Evaluation of The Term “State of Law” From The Stand Point of Turkish History
Abstract
When the state of law is mentioned, it is understood, firstly, that the
state itself is bound by law. In other words, the state is not only an entity that
sets the rules of law, but also a legal entity that firstly complies with these
rules. When it is evaluated in terms of Turkish history, it is seen that the understanding
of the state of law appears with different applications. In order
to reach the modern version of the state of law; the West passed many stages
like the state which is the posseser of all property, the Police state, and finally
the state of law. The stages in the West in achieving the goal of the state
of law have been seen in different ways in our history. In this study, the understanding
of the state of law is briefly evaluated in terms of Turkish history
and the conditions of the state of law are emphasized.
